TERMS AND CONDITIONS OF SALE – MUNAÉ COMPANY

1. PURPOSE

These Terms and Conditions of Sale (T&Cs) apply to the company MUNAÉ, registered with the Paris Trade and Companies Register under number 935 074 658 R.C.S. Paris, represented by Mrs. Sarah Gracia as President.

The company’s registered office is located at 38 rue de Berri, 75008 Paris, and it sells products through its website. These T&Cs define the conditions for remote sales and delivery of products offered on the website www.ateliermunae.com.

By placing an order on this site, the Client fully and unreservedly agrees to these T&Cs unless otherwise agreed in writing prior to the order. Munaé reserves the right to modify these terms at any time.

By accessing this website, we assume that you accept these terms and conditions.

1.a. License

Unless otherwise stated, Munaé and/or its licensors own the intellectual property rights for all content on Atelier Munae. All rights are reserved.

You must not:

  • Copy or republish content from Munaé;

  • Sell, rent or sub-license content from Munaé;

  • Reproduce, duplicate or copy content from Munaé;

  • Redistribute content from Munaé.

This agreement takes effect on the date of your first visit to the website.

2. PRODUCTS

Munaé offers for sale art objects and furniture, made using artisan or other manufacturing methods.

Products are available for sale while stocks last or can be made to order. Essential information about each product is presented on the website in both French and English, in accordance with Article L. 111-1 of the French Consumer Code.

Product photographs are as accurate as possible, but color or texture variations may occur due to screen settings or materials used. These differences do not constitute a defect or grounds for complaint.

Handcrafted products may feature natural variations in color, size, or texture, which are part of their authenticity and uniqueness.

3. PRICES

3.1 Price Display

Product prices are displayed in euros, inclusive of all taxes (VAT included).

The displayed price does not include:

  • Shipping fees, which will be specified before the order is confirmed;

  • Customs duties and local taxes applicable to orders outside the EU, which are payable by the Client;

  • Bank or telecommunication charges related to accessing the site.

3.2 Price Changes

Munaé reserves the right to modify its prices at any time. However, the prices applied are those displayed at the time the Client places the order.

4. ORDER

4.1 Placing an Order

To validate an order, the Client must follow these steps:

  1. Select one or more products

  2. Add to cart and verify the order summary (size, materials, timeframe)

  3. Enter personal and shipping information (building, access code, floor, etc.)

  4. Validate the order with payment obligation

Once the order is confirmed, a confirmation email will be sent to the Client. From that moment, the order is final, except where the Client exercises their right of withdrawal as defined in Article 7.

For custom-made products, the Client cannot cancel the order, in accordance with Article L 221-28 of the French Consumer Code, which excludes withdrawal rights for such orders.

For professionals or private clients paying via bank transfer, we can provide a custom quote and handle the order outside the website. For any questions, please contact us at info@ateliermunae.com.

Clients are advised to keep the order confirmation for their records.

4.2 Order Cancellation or Suspension

The seller reserves the right to cancel any order in case of product stock shortage. In this case, the buyer will be informed by email and refunded if necessary. A substitute product may be proposed, subject to availability.

Additionally, the seller reserves the right to suspend or cancel any order, regardless of its nature or progress, in the event of non-payment or partial payment by the buyer.

5. PAYMENT

Orders must be paid exclusively in euros, either by credit card or bank transfer. Orders will be processed only after receipt of payment.

5.1 Data Security and Payment Options

The seller takes all necessary measures to ensure the security and confidentiality of online transactions.

6. INTELLECTUAL PROPERTY

The buyer agrees to respect the seller's intellectual property rights. All site elements such as images, videos, designs, text, music, and products (including trademarks) are the exclusive property of Munaé or its partners and are protected by applicable intellectual property laws.

The user agrees not to infringe upon these rights. Any reproduction, adaptation, or exploitation of protected elements without written authorization from Munaé constitutes a violation of intellectual property law.

7. RIGHT OF WITHDRAWAL

The Client has a 14-day withdrawal period from the date of receipt of the product, provided the product is returned in perfect condition and in its original packaging.

Return shipping costs are the responsibility of the Client.

Refunds will be processed within a maximum of 20 days.

8. DELIVERY

Orders are delivered to the address provided by the Client. Any error or omission in shipping information is the responsibility of the buyer.

Delivery time is indicated during order confirmation but may be delayed due to external circumstances (force majeure, strikes, etc.).

Delivery delays do not entitle the Client to compensation.

The seller is not responsible for product loss. Transport risks are borne by the Client, who must lodge any complaint directly with the carrier.

Shipping costs are calculated based on weight and destination. Bulky items are shipped via custom delivery, with transport times ranging from 4 to 6 weeks.

Any additional costs for special handling (cranes, lifts, etc.) are at the Client’s expense and will be invoiced by the service provider in addition to the sale price and shipping fees.

If redelivery is required, additional shipping costs must be paid in advance in the following cases:

  • Client not present at delivery

  • Incorrect delivery address

  • Delivery impossible due to unreported access issues

Once the buyer receives the products, they assume full responsibility for any risks of damage. It is the buyer's duty to inspect the package upon delivery and notify the carrier of any issues.

9. LIABILITY

The seller shall not be held liable for improper use of products or damage caused by a third party. Buyers must use products according to the label instructions and any other documentation provided.

If a product is non-compliant, the Client must contact Customer Service within 7 days of delivery. After this period, the seller reserves the right to assess the validity of the claim on a case-by-case basis.

The seller is not liable for any situation of force majeure, as defined by French courts. This includes: extreme weather, natural disasters, fires, floods, explosions, terrorist attacks, wars, riots, epidemics, administrative restrictions, or any disruption of transport or postal services (including strikes).

Any legal or regulatory obligation imposed by authorities which significantly alters the T&Cs also constitutes force majeure.

10. RETURNS

Any product to be exchanged or refunded must be returned in its original condition and packaging, with all components included.

Return risks are the responsibility of the Client. If procedures or deadlines are not respected, no claim for non-conformity or visible defect will be accepted.

11. GOVERNING LAW AND DISPUTES

These T&Cs are governed by French law. In case of dispute, an amicable resolution will be sought before any legal action.

Any disputes will fall under the jurisdiction of French courts.
